Standard Operating Policies and Terms of Service

T-Town Mobility Sales Returns Policy

All sales are considered final, unless specially outlined below.

Eligibility: Returns are only accepted for POWER (electric) wheelchairs/electric mobility scooters that were in stock at the time of purchase and/or not special-ordered.

Timeframe: Returns must be initiated and brought back within 24 hours of the original time of purchase.

Condition: The item must be in like-new, resalable condition with no signs of damage or wear.

Documentation: All original paperwork, manuals, and receipts must be included with the return.

RMA Requirement: A Return Merchandise Authorization (RMA) must be obtained from the Seller. The request must include a stated reason for the return and a confirmation that there are no known issues with the item. Approval not guaranteed.

Fees and Refunds: All returns are subject to a 20% restocking fee. Refunds will be issued in the form of in-store credit only. Original delivery and set-up fees are non-refundable.

Non-Returnable Items

The following items are considered final sale and cannot be returned for health and hygiene reasons:

  • Any product demonstrating usage, damage, or missing original components or packaging.
  • Hygiene-related products, including but not limited to bath safety items (commodes, shower chairs, transfer benches), mattresses, cushions, and opened braces.
  • Custom-ordered equipment, special-order items, or parts.
  • Lift chairs and hospital beds due to weight and sanitation logistics.

T-Town Mobility Rental Policy

1. Customer Responsibility and Condition

Duty of Care: The Customer assumes full responsibility, to the extent permitted by law, for the custody, safe operation, and preservation of all rented equipment from the moment of transfer until the equipment is formally returned.

Condition at Delivery: Equipment condition will be documented at the time of delivery via checklist and/or photo/video. By accepting delivery, the Customer acknowledges that the equipment is in good working condition unless otherwise noted at that time.

Return Condition: Equipment must be returned in the same condition as received, allowing only for normal wear and tear as determined by T-Town Mobility. Normal wear and tear does not include structural damage, battery damage, misuse, or excessive dirt/debris.

Hospital Bed: Optional Water/Stain proof Mattress protector for purchase is highly recommended ($15.00, non-refundable). If waived and mattress is returned unusable due to stains, odors (not limited to urine, smoke, etc), a $150.00 mattress replacement will be charged.

Liability for Loss and Damage: The Customer is liable for the full cost of repair or replacement resulting from damage, loss, or theft. The Customer authorizes T-Town Mobility to charge the payment method on file for all associated costs, including parts and labor.

Inspection Timeline: All returned equipment will be inspected within 3 business days of return. Any applicable charges for damage, excessive wear, or cleaning may be applied following inspection.

Modifications: The Customer shall not modify, alter, or attempt to repair the equipment without prior written consent.

Permitted Use: Equipment must be used only as intended and within manufacturer guidelines, including weight limits and environmental conditions.

2. Delivery and Setup

Site Readiness: The Customer is responsible for preparing the delivery site and ensuring a clear and safe path. T-Town Mobility personnel are not responsible for moving furniture or clearing obstacles. Failure to prepare the site may result in cancellation and forfeiture of delivery fees.

Delivery Procedure: An adult must be present to receive, sign for, and review operation of the equipment at delivery.

Delivery Timing: Delivery times are estimates and are not guaranteed.

3. Cleaning Fees

Equipment returned requiring excessive cleaning, including but not limited to heavy dirt, pet hair, bodily fluids, or biohazards, will result in a minimum $50 non-refundable cleaning fee, which may exceed this amount based on condition. Determination of excessive cleaning is at the sole discretion of T-Town Mobility.

4. Late Returns and Automatic Renewal

Due Date: Equipment must be returned by the close of business on the agreed-upon due date.

Automatic Renewal: Failure to return equipment by the due date constitutes agreement to renew the rental for an additional term equal to the original rental period. The Customer authorizes immediate, non-refundable, and non-prorated charges for the renewal term.

Acknowledgment Required: Customer must explicitly acknowledge and agree to this automatic renewal clause at the time of rental.

5. Payment Authorization

By entering into a rental agreement, the Customer authorizes T-Town Mobility to securely store payment information and charge any outstanding balances, including fees for damages, cleaning, late returns, renewals, or other charges incurred. The Customer authorizes charges as incurred, including partial and multiple charges without additional notice.

6. Maintenance and Assumption of Risk

Operational Safety: The Customer acknowledges that use of mobility equipment involves inherent risks and assumes all responsibility for injury or damage resulting from use or misuse.

Maintenance: The Customer is responsible for basic daily inspection and must report any issues immediately.

Additional Legal Terms

Indemnification

The Customer agrees to indemnify, defend, and hold harmless T-Town Mobility, its owners, employees, and affiliates from any claims, liabilities, damages, or expenses arising from the use, misuse, or possession of rented or purchased equipment.

Limitation of Liability

To the fullest extent permitted by law, T-Town Mobility shall not be liable for any indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid by the Customer for the equipment or rental.

Warranty Disclaimer

All equipment is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Force Majeure

T-Town Mobility shall not be liable for delays or failure to perform due to events beyond its control, including but not limited to weather, natural disasters, supply disruptions, or labor shortages.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma.

Severability

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Abandonment

Equipment not returned within 7 days of the due date, after reasonable attempts to contact the Customer, may be considered abandoned. T-Town Mobility reserves the right to charge the full replacement value of the equipment.

Repossession

T-Town Mobility reserves the right, to the extent permitted by law, to recover or repossess equipment that is not returned as agreed.

Refusal or Termination of Service

T-Town Mobility reserves the right to refuse or terminate service at its discretion, including but not limited to safety concerns, misuse of equipment, or suspected fraud.

Dispute Resolution and Chargebacks

The Customer agrees to contact T-Town Mobility to resolve any billing disputes prior to initiating a chargeback. By agreeing to these terms, the Customer acknowledges that authorized charges in accordance with this agreement are valid.

Communication Consent

The Customer consents to being contacted via phone, text message, or email for purposes including delivery coordination, account updates, and billing matters.

Fraud and Payment Representation

The Customer represents and warrants that they are authorized to use the payment method provided and that all information supplied is accurate.

Entire Agreement

This agreement constitutes the entire agreement between the parties and supersedes all prior discussions or representations.

No Waiver

Failure by T-Town Mobility to enforce any provision of this agreement shall not constitute a waiver of that provision.

Assignment Restriction

The Customer may not assign or transfer their rights or obligations under this agreement without prior written consent from T-Town Mobility.

Acceptance of Terms

By purchasing or renting equipment, the Customer acknowledges that they have read, understood, and agree to these Terms of Service. A signed agreement or electronic acceptance may be required.
